Flying Tumbler Terms of Service
Welcome to Flying Tumbler. These Terms of Service govern your use of flyingtumbler.com (the "Site") and your purchase of Flying Tumbler products. By placing an order, you confirm you have read these terms and agree to be bound by them.
Flying Tumbler Irish Whiskey is operated by Mount Leinster Distillers Ltd, registered in Ireland, with offices at Ballytarsna, Nurney, Co. Carlow.
1. Who can purchase
You must be at least 18 years of age — or the legal drinking age in your jurisdiction, whichever is higher — to purchase any alcohol product from this Site. By placing an order you confirm that you meet this requirement. We reserve the right to refuse or cancel any order where we have reason to believe this is not the case.
2. Where we sell, and how the sale takes place
Flying Tumbler is operated from Ireland and all sales are concluded under Irish law between you and Mount Leinster Spirits Ltd. Depending on the destination, product, stock location, and operational considerations of each order, fulfilment may be carried out from our own warehouse in Ireland, from a trusted fulfilment partner, or from a licensed retailer partner acting on our behalf. Title to the goods passes to you at the point of dispatch from the fulfilling location, on Incoterm EXW. We (or any partner acting on our behalf) then arrange shipping using carriers experienced in handling alcohol responsibly.
3. Buyer as Importer of Record (non-EU destinations)
For orders shipped outside the European Union, including to the United Kingdom and the United States:
You acknowledge that you are the importer of record of the goods into the destination country.
You authorise Flying Tumbler — and any fulfilment partner, retailer partner, or shipping provider acting on our behalf — to act as your shipping agent for the purpose of completing the necessary export documentation, customs declarations, and engaging the carrier on your behalf.
You are responsible for paying any and all import duties, taxes, tariffs, brokerage fees, and customs charges levied by the destination country's authorities.
You are responsible for ensuring that the importation and personal use of Irish whiskey is lawful at your delivery address, and for any age-verification requirements applicable on receipt.
Flying Tumbler is not liable for parcels detained, seized, or refused by customs authorities, nor for any duties or fees levied on arrival. Where a parcel is seized, we may issue a goodwill refund or credit at our sole discretion, but no automatic right of refund arises.
4. Restricted destinations
We do not currently ship whiskey to all destinations. In the United States, we do not ship to Texas, Utah, Kentucky, Mississippi, or Pennsylvania. Checkout will refuse delivery addresses in those states. We reserve the right to add or remove destinations from time to time. You should not place an order to a restricted destination — if you do, we will cancel and refund.
5. Pricing and currency
Prices are shown in your detected market currency. For customers in Ireland and the European Union, prices are shown inclusive of Irish VAT at 23%. For customers outside the EU, prices are shown exclusive of any import VAT, excise, or duty that may apply on arrival.
6. Payment
Payments are processed by Shopify Payments. We accept major credit and debit cards, Apple Pay, Google Pay, and Shop Pay. All transactions are settled in EUR to Flying Tumbler in Ireland. Your card issuer may apply a foreign-exchange charge if your card is denominated in a different currency.
7. Cancellations and changes
You may cancel an order at no charge before it is dispatched. Once dispatched, the order cannot be cancelled and is subject to our Refund Policy.
8. Delivery
Delivery times, carrier choices, and conditions are set out in our Shipping Policy. Delivery dates are estimates and not guaranteed.
9. Risk of loss
Risk in the goods passes to you at the point title passes — at the fulfilling warehouse on dispatch. For international shipments, any loss or damage in transit is a matter between you (as importer of record) and the carrier. Flying Tumbler will assist with claims where reasonable but is not the insured party.
10. Limitation of liability
Nothing in these terms excludes our liability for death, personal injury caused by negligence, fraud, or any other liability that cannot be excluded by law. Subject to that, our total liability arising out of or in connection with any order shall not exceed the amount paid by you for that order.
11. Governing law
These terms are governed by the laws of Ireland. Any dispute shall be subject to the exclusive jurisdiction of the Irish courts.
12. Changes to these terms
We may update these terms from time to time. The version in force at the time you place your order will apply to that order.
